Our general terms and conditions of sale comply with the provisions of Article R.211-12 of the French Tourism Code. In order to comply with legal requirements, we reproduce Articles R.211-3 to R.211-11 of the aforementioned Code

Art. R.211-3 – Subject to the exclusions provided in the third and fourth paragraphs of Article L.211-7, any offer or sale of travel or holiday services must be accompanied by appropriate documents that comply with the rules defined in this section. In the case of the sale of airline tickets or tickets for regular transport lines not accompanied by related services, the seller must provide the buyer with one or more travel tickets issued by the carrier or under its responsibility. In the case of on-demand transport, the name and address of the carrier on whose behalf the tickets are issued must be specified. Separate billing of the various elements of a single travel package does not exempt the seller from the obligations imposed by the regulations of this section

Art. R.211-3-1 – The exchange of pre-contractual information or the provision of contractual terms must be done in writing. This can be done electronically under the validity conditions provided in Articles 1369-1 to 1369-11 of the French Civil Code. The name or corporate name and address of the seller must be indicated, along with the registration information in the register referred to in a) of Article L.141-3, or, where applicable, the name, address, and registration details of the federation or union referred to in the second paragraph of Article R.211-2

Art. R.211-4 – Before concluding the contract, the seller must provide the consumer with information regarding prices, dates, and other components of the services provided during the travel or stay, including:

  1. the destination, means, characteristics, and categories of transport used

  2. the type of accommodation, its location, level of comfort, main features, approval, and official or customary tourist classification in the host country

  3. the catering services offered

  4. the itinerary in the case of a tour

  5. administrative and health formalities required for nationals or residents of another EU member state or a state party to the EEA agreement, particularly when crossing borders, and the deadlines for completing them

  6. excursions, visits, and other services included in the package or optionally available for an additional price

  7. the minimum or maximum group size required to carry out the travel or stay, and if applicable, the deadline for informing the consumer in case of cancellation due to insufficient participants, which cannot be set less than 21 days before departure

  8. the amount or percentage of the price to be paid as a deposit and the schedule for paying the balance

  9. the terms of price revisions as provided in the contract under Article R.211-8

  10. contractual cancellation terms

  11. statutory cancellation terms under Articles R.211-9, R.211-10, and R.211-11

  12. information regarding optional insurance covering certain cancellations or assistance insurance covering specific risks, including repatriation in case of accident or illness

  13. for contracts including air transport, information for each flight segment as required by Articles R.211-15 to R.211-18

Art. R.211-5 – The prior information provided to the consumer is binding on the seller unless the seller has expressly reserved the right to modify certain elements. In such cases, the seller must clearly indicate the scope of any possible modification and which elements it may affect. Any changes must be communicated to the consumer before the contract is concluded.

Art. R.211-6 – The contract concluded between the seller and the buyer must be in writing, in duplicate, with one copy given to the buyer, and signed by both parties. For contracts concluded electronically, Articles 1369-1 to 1369-11 of the Civil Code apply. The contract must include:

  1. the name and address of the seller, their guarantor and insurer, and the organizer

  2. the destination(s) and, if applicable, multiple periods with dates

  3. the means, characteristics, and categories of transport, departure and return dates and locations

  4. the type of accommodation, location, comfort level, main features, and official or customary classification

  5. catering services provided

  6. the itinerary for tours

  7. excursions or other services included in the total price

  8. total price of the services and any possible revisions under Article R.211-8

  9. any applicable taxes or fees such as landing, embarkation, disembarkation fees, or tourist taxes not included in the price

  10. payment schedule and conditions; the final payment must be at least 30% of the total price and made when documents enabling travel are provided

  11. any special conditions requested by the buyer and accepted by the seller

  12. procedures for submitting complaints regarding non-performance or poor performance of the contract, to be sent promptly with proof of receipt, and if necessary, reported in writing to the organizer and service providers

  13. the deadline for informing the buyer in case of cancellation due to insufficient participants as per Article R.211-4(7)

  14. contractual cancellation terms

  15. statutory cancellation terms under Articles R.211-9, R.211-10, and R.211-11

  16. insurance coverage details for professional liability

  17. insurance or assistance coverage for certain cancellation or specific risks, including insurer name and policy number, and minimum coverage/exclusions

  18. deadline for notifying the seller if the buyer assigns the contract

  19. commitment to provide the buyer at least 10 days before departure with:
    a) contact details of the local representative or local organizations for emergency assistance
    b) for minors traveling abroad, a direct contact number for the child or responsible supervisor

  20. termination and refund clause without penalty if the seller fails to provide the required information under Article R.211-4(13)

  21. commitment to provide departure and arrival times before the travel or stay

Art. R.211-7 – The buyer may transfer their contract to another person meeting the same conditions, provided the contract has not yet taken effect. Unless otherwise agreed, the buyer must notify the seller at least seven days before departure, or fifteen days for cruises. No prior authorization from the seller is required

Art. R.211-8 – If the contract allows price revision, it must specify the calculation method for increases or decreases, including transport costs, taxes, currency exchange rates affecting the price, and the portion of the price subject to variation

Art. R.211-9 – If the seller modifies an essential element of the contract, such as a significant price increase, without complying with the information requirement under Article R.211-4(13), the buyer may:

- either cancel the contract and receive a full refund without penalty

- or accept the modification or substitute travel offered by the seller, with a contract amendment signed by both parties; any price reduction is deducted from remaining payments, and overpayments are refunded before departure

Art. R.211-10 – In the case provided for in Article L.211-14, if, before the buyer’s departure, the seller cancels the trip or stay, the seller must inform the buyer by any means allowing acknowledgment of receipt. Without prejudice to any claims for damages that may be incurred, the buyer is entitled to an immediate and full refund from the seller without penalty. In this case, the buyer also receives compensation at least equal to the penalty they would have borne if the cancellation had occurred on their own initiative on that date. The provisions of this article do not prevent the parties from reaching an amicable agreement whereby the buyer accepts a substitute trip or stay offered by the seller.

Art. R.211-11 – If, after the buyer’s departure, the seller is unable to provide a substantial part of the services specified in the contract, representing a significant portion of the price paid by the buyer, the seller must immediately take the following measures, without prejudice to any claims for damages that may be incurred

- either offer replacement services in place of the original services, potentially covering any additional costs, and if the accepted services are of lower quality, the seller must refund the price difference to the buyer upon their return

- or, if no replacement services can be provided, or if the buyer validly refuses the offered replacement, provide transport tickets at no additional cost to ensure the buyer’s return under conditions reasonably equivalent to the departure location or another location agreed upon by both parties

The provisions of this article also apply in the event of failure to meet the information obligation set out in Article R.211-4(13)

Special Terms and Conditions of Sale


 

ARTICLE 1 – RESERVATION / PAYMENT

1.1 Reservation Conditions

The client acknowledges having read the General Terms and Conditions of Sale provided by Hôtel Les Trésoms and confirms having requested and obtained all the necessary information to make a reservation with full knowledge and understanding.

Before any reservation, the client undertakes to complete all required information on the booking form or reservation request and certifies the accuracy and truthfulness of the information provided.

For any booking of more than 7 rooms, the applicable terms and conditions are those in force at Hôtel Les Trésoms for leisure groups or corporate/seminar groups.

1.2 Reservation Guarantees

Every reservation must be secured with a deposit or payment guarantee:

  • For all stays, a valid credit card number* is required. The hotel reserves the right to carry out a pre-authorization and/or PLBS** on the card provided.

  • For any stay longer than 7 nights and/or during special event periods, a deposit corresponding to:

    • 30% of the total price of the stay, including any additional services (meals, spa, activities, etc.),

    • 50% of the total price of the stay, including any additional services, for stays during event periods.

* Visa Electron, Maestro, and American Express cards are not accepted as booking guarantees, but may be used for payment at the hotel. (E-cards are not accepted for booking or payment at Hôtel Les Trésoms).

** PLBS (“Payment for the Rental of Goods and Services”) is a security deposit system requested by the cardholder’s bank. This service allows the hotel to guarantee a reservation by blocking a certain amount on the client’s account for a period determined by the bank. The blocked amount is included in the client’s available balance but is not debited unless used.

An invalid card or failed pre-authorization/PLBS request will automatically and officially cancel the reservation. Hôtel Les Trésoms reserves the right to refuse any reservation if the card details are incorrect, invalid, or the booking incomplete.

1.3 Right of Withdrawal

- From the date of deposit payment up to the 30th day prior to the stay (for any reservation under 20 nights in total), the client benefits from a right of withdrawal. In such cases, the deposit will be refunded, minus a €50 administration and cancellation fee, which remains payable to Hôtel Les Trésoms.

- Please note that activities relating to the organization and sale of stays for a fixed date or period are not subject to the 14-day withdrawal period applicable to distance sales.

1.4 Balance Payment

The full amount of the stay and any additional services is due immediately after consumption, and must be settled on site no later than 12:00 noon on the day of departure.

1.5 Accepted Payment Methods

For any reservation, payment may be made by:

  • Cash, up to €1,000, at the reception desk only,
  • Credit card*,
  • Cheque**,
  • Bank transfer***,
  • Vouchers or gift certificates****.

(*) Accepted credit cards: Visa, Eurocard/Mastercard, Carte Bleue, American Express.
A 5% handling fee applies to payments made with American Express.

(**) Accepted cheques: personal cheques up to €1,000, or above €1,000 with additional bank guarantees. Valid holiday vouchers are accepted for up to 50% of the total invoice.

(***) Only for prepayments or deposits made at least 8 days prior to the beginning of the stay.

(****) Partner gift vouchers/cheques (subject to hotel validation) valid at the time of payment.

Guarantee: The hotel reserves the right to request a valid credit card number at the start of the stay to secure any additional charges.

Please note that no refunds will be issued for overpayments made with partner gift vouchers or cheques.

ARTICLE 2 – PRICES

2.1 – Prices

Service rates are established based on the economic conditions in effect at the time of pricing. Any changes in applicable taxes may result in a corresponding adjustment of service prices. Rates are flexible and may vary according to customizable criteria such as booking date, check-in date, length of stay, type of accommodation, and additional services.

Prices are quoted in Euros and always include VAT. Only the price stated in the booking confirmation is binding.

2.2 – Accommodation

Our rates include all applicable taxes and utility charges (water, electricity, heating), with the exception of the local tourist tax and any additional services payable at reception when due.

Please note that each accommodation is designed for a specific maximum occupancy and under no circumstances may it be occupied by a higher number of persons. Infants and young children count as full occupants. Not all balconies, terraces, loggias, or garden-level areas are equipped with tables and chairs.

2.3 – Optional Services

Accommodation rates do not include additional optional services that may be offered.

2.4 – Discounts

Any discounts promoted on our sales channels apply exclusively to accommodation. All other services (meals, sports, leisure activities, etc.) are excluded.

2.5 - Packages

Only the services explicitly mentioned in the electronic booking form are included in the package.

  • The number of breakfasts corresponds to the number of nights booked at the hotel.
  • Full board begins with dinner on the first night and ends with breakfast on the last morning.
  • Half board includes breakfast and one meal per day.
  • Drinks are only included when expressly stated.

Activities and services: While all activities and services described have been confirmed by our partners and published in good faith, they may be suspended or cancelled without prior notice due to circumstances beyond our control.

MontSpa Les Trésoms: It is the guest’s responsibility to check spa availability and book any treatments included in their stay. If no booking is made, Hôtel Les Trésoms will make the reservation on the guest’s behalf for treatments included in the package. Spa access is regulated; guests must familiarize themselves with the current rules in effect.

Restaurants: It is the guest’s responsibility to check restaurant availability and book meals included in their stay. If no booking is made, Hôtel Les Trésoms will make the reservation on the guest’s behalf in one of the restaurants included in the package, or in a partner restaurant.

For package bookings, any unused services included in the package are non-refundable and cannot be exchanged for a discount.

ARTICLE 3 – TOURIST TAX

The tourist tax, collected on behalf of local municipalities, is not included in our rates. The amount is calculated per person, per day, and varies depending on the destination. It must be paid either on site or at the time of booking, depending on the case.

ARTICLE 4 – BOOKING MODIFICATION / CANCELLATION BY THE CLIENT

4.1 – Modification of the stay and/or optional or packaged services

Any request to modify a reservation must be submitted in writing to Hôtel Les Trésoms. A reservation change only becomes effective once a written confirmation has been received from Hôtel Les Trésoms.

Any request to reduce the length of stay, the number of rooms, or optional services will be treated by Hôtel Les Trésoms as a partial cancellation and will be subject to the cancellation policy set out in Article 4.2 below.

For stays longer than 3 nights, we will make every effort to accommodate requests for changes to dates, room type, or optional services, subject to availability. If the total price of the modified reservation is lower than the original amount, a €10 modification fee will be retained.

No modification requests will be accepted if received from the 2nd day prior to arrival.

If you booked through an intermediary (online travel agencies, comparison websites, booking platforms, etc.), you must contact that same intermediary directly to manage any modifications.

Note:

  • Any request to extend the length of your stay will be processed by Hôtel Les Trésoms free of charge.
  • Any request to shorten the length of your stay will be treated as a partial cancellation and subject to the cancellation policy described in Article 4.2.

4.2 – Cancellation (total or partial)

In the event of cancellation, you must notify us in writing:

  • If you booked directly (by phone, email, post, or via our website www.lestresoms.com):

    • By email at info@lestresoms.com

    • By post at: Hôtel Les Trésoms, 15 Boulevard de la Corniche, 74000 Annecy

    • Via the cancellation link provided in your booking confirmation email

  • If you booked through an intermediary (online travel agencies, comparison websites, booking platforms, etc.), you must contact that intermediary directly to manage the cancellation.

The cancellation date is determined by the date on which the written notification is received.

4.2.1 – Cancellation fees

For any stay of fewer than 7 nights, a cancellation fee equal to 1 night’s stay* will apply for cancellations made less than 7 days before the scheduled arrival date (except for rates subject to Article 5).

For any stay of more than 7 nights, your stay is guaranteed by a deposit. Regardless of the cancellation notice period, deposits are non-refundable and remain due to Hôtel Les Trésoms (except under Article 1.3).

*The “nightly rate” corresponds to the total cost of the booked stay divided by the number of nights reserved. For a package stay, the fee will be calculated according to the same principle.

4.3 – No-show at Hôtel Les Trésoms

If you fail to arrive at Hôtel Les Trésoms on the scheduled date of your reservation without prior cancellation, the total amount of your stay will be retained as compensation, and the entire booking will be cancelled.

ARTICLE 5 – NON-EXCHANGEABLE / NON-MODIFIABLE / NON-REFUNDABLE STAYS, SERVICES AND OFFERS

Certain offers or stays are designated as “Non-exchangeable, non-modifiable, non-refundable.” For these stays or services, the following conditions apply instead of the modification and cancellation terms outlined in Article 4.

5.1 – Non-exchangeable, non-refundable, non-modifiable nature

Given the preferential rate granted by Hôtel Les Trésoms, subscriptions to these Offers / services and/or booked Stays are strictly non-exchangeable, non-refundable, and non-modifiable. No modification or cancellation requests will be accepted.
Regardless of the cancellation date, a cancellation fee equal to 100% of the total amount of the booked Offer / services and/or Stay will be applied.

5.2 – No-show at Hôtel Les Trésoms

If you fail to arrive at Hôtel Les Trésoms on the scheduled check-in date, the total amount of your stay will be retained as compensation, and the entire booking will be cancelled.

ARTICLE 6 – ARRIVAL AND DEPARTURE

The credit card used for the booking, along with valid identification documents, must be presented upon arrival. Otherwise, Hôtel Les Trésoms reserves the right to deny access to your accommodation.

For all stays, keys are available from 4:00 p.m. on the day of arrival and must be returned before 11:00 a.m. on the day of departure.

Guests are required to complete a police registration form upon arrival, in accordance with current regulations.

ARTICLE 7 – MINORS / LEGAL CAPACITY TO CONTRACT

Please note that our establishment is not a “Holiday and Leisure Center” as defined by Decree No. 2002-883 of May 3, 2002, and is therefore not suitable for hosting collective or individual stays of minors under the age of 18 unaccompanied by their legal guardians.
Hôtel Les Trésoms reserves the right to refuse access to any room or house booked in violation of this condition if minors under 18 present themselves without their legal guardians, and may proceed with the immediate cancellation of the stay.
Under the same conditions, Hôtel Les Trésoms may also cancel the booking at any time prior to arrival if it is discovered that the accommodation was reserved for minors under 18 without their legal guardians.

Each guest acknowledges that they have the legal capacity to contract, meaning they are of legal age and not under guardianship or curatorship.

ARTICLE 8 – PETS

Pets are allowed in the Hotel section of the establishment for an additional nightly fee, payable on site. They are permitted in common areas provided they are kept on a leash, but are strictly prohibited in the pool area, restaurants, and the wellness/spa facilities.

ARTICLE 9 – HOUSE RULES

9.1 – Room occupancy 

For safety and insurance reasons, rooms may not accommodate more guests than indicated in the safety register:

Single: 1 occupant

Double: 2 occupants

Any request for an additional occupant (children or infants) must be made at the time of booking and accepted by Hôtel Les Trésoms, subject to the availability of rooms suitable for the requested occupancy.

The use or provision of a baby bed must be subject to prior approval from Hôtel Les Trésoms.

9.2 – Conduct

Proper physical and moral conduct is required. Any act likely to disturb other guests, cause disruption, or result in material damage is strictly prohibited.

Guests are expected to behave respectfully towards one another and towards hotel staff.

For safety and hygiene reasons, babies and young children are not permitted in MontSpa Les Trésoms.

9.3 – Use of rooms

All our rooms are non-smoking.
In accordance with Decree No. 2006-1386 of 15/11/2006 regarding smoking in collective-use spaces, any guest failing to comply will be charged an immediate €150 fee for damages and additional cleaning. If the violation is discovered after departure, Hôtel Les Trésoms reserves the right to charge this amount to the guest’s credit card. An invoice will be issued and sent to the guest.

Room condition: Rooms are not intended for laundry or for consuming meals other than those provided by the establishment (Room Service and continental breakfast).

Hôtel Les Trésoms will refuse any external food and/or drink deliveries.

Water must not be used outside the equipment provided for this purpose.

Hôtel Les Trésoms may charge a €150 cleaning fee if the room is left in a state requiring additional cleaning, drying, or dehumidification.

9.4 – Valuables

Hôtel Les Trésoms and its staff cannot be held responsible for the loss or theft of any personal belongings. A safe with instructions for use is available in all rooms.

9.5 – Damage and deterioration

Any damage caused to the rooms or common areas will be billed based on the cost of replacement or repair, as well as any related loss of business.

ARTICLE 10 – INTERRUPTION OF STAY / INTERRUPTION OF LEISURE ACTIVITIES

An early departure or the interruption of a leisure activity booked through Hôtel Les Trésoms will not give rise to any refund. Any stay started is fully due. Any service included in a package but not used remains fully payable.

ARTICLE 11 – POSSIBLE MODIFICATION OF YOUR STAY

If circumstances require, and only in cases of force majeure beyond our control, we may be obliged to partially or completely modify your program (closure of shared facilities such as pool, restaurant, spa, etc.) or to accommodate you in a nearby hotel of equivalent category.

ARTICLE 12 – AFTER-SALES SERVICE

Our on-site teams are available throughout your stay to address any concerns, resolve any issues you may encounter and ensure you enjoy your experience to the fullest. Please contact them directly for any request. Any complaint after your stay may be submitted within fifteen days following the end of your stay either by registered letter with acknowledgment of receipt to Hôtel Les Trésoms, 15 Boulevard de la Corniche, 74000 Annecy or by email to info@lestresoms.com. Please note that the longer you wait to notify us of your complaint, the more difficult it may be for us to resolve it in your best interest. In order to facilitate the processing of your request, we kindly ask you to specify in your correspondence the name of the person who made the booking, the reservation number, the dates and location of your stay, as well as the type of room reserved, and to include any supporting documents that may help us reduce the processing time.

Any dispute, claim or litigation related to the booking of a stay or hotel room is subject to French law. It is your responsibility to check before your reservation whether local events such as carnivals, religious holidays or national holidays may affect the smooth running of your stay, and no complaint in this respect will be accepted later by Hôtel Les Trésoms.

ARTICLE 13 – VALIDITY OF GENERAL TERMS AND CONDITIONS

Booking a stay or a service at our establishment implies full acceptance of these general and specific terms of sale. These conditions apply as of the printing date and replace any prior versions.

Descriptions and photographs of rooms are provided as a guide. Due to the diversity of our rooms, some differences in layout and decoration may exist. Our website provides general descriptions, layout examples, photographs, and virtual tours, all for information purposes.

No claims will be accepted regarding such differences, provided the essential characteristics of the offer booked are respected.

All information on sports and leisure activities, as well as their surroundings, is provided by local tourist offices and is for guidance only. Hôtel Les Trésoms cannot be held responsible if certain activities are no longer available during your stay. Similarly, construction work carried out by private individuals or public authorities that may cause inconvenience cannot be opposed to us.

These General Terms of Sale apply to all booking channels for Hôtel Les Trésoms (all websites, online booking platforms, telephone, email, fax, and in person).

ARTICLE 14 – LIABILITY – LIMITATION

Hôtel Les Trésoms is responsible for the conformity of its services in accordance with Articles L. 212-1 et seq. of the French Consumer Code. The client also benefits from any contractual guarantee that may apply to the service.

More generally, Hôtel Les Trésoms cannot be held liable for poor performance of the stay if it is attributable to the client, to a force majeure event (strikes, weather, natural disasters, illness, vehicle breakdowns, travel cancellations, etc.), or to an unforeseeable and unavoidable act by a third party unrelated to the contract.

ARTICLE 15 – FORCE MAJEURE

Force majeure is defined as any external event, unforeseeable and unavoidable, preventing either the client or Hôtel Les Trésoms from fulfilling part or all of their contractual obligations.

It is expressly agreed that force majeure suspends the performance of mutual obligations. Each party bears the costs incurred as a result.

The client remains solely responsible for any additional expenses required to continue the stay following a case of force majeure.

ARTICLE 16 – PERSONAL DATA

Your personal data is collected by Hôtel Les Trésoms, as data controller, and stored in its database. Certain data is necessary to manage your booking and may also be used to send you information and/or promotional offers regarding our products and services.

In accordance with the French Data Protection Act of January 6, 1978, you have the right to access, modify, and oppose the use of your data for marketing purposes. To exercise these rights, please send a written request to: Hôtel Les Trésoms, 15 Boulevard de la Corniche 74000 ANNECY
